1. Acceptance of Terms

By accessing or using CVGenerate Studio (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CVGenerate Studio provides AI-powered resume and cover letter generation services. The Service uses artificial intelligence models to analyze your resume and job descriptions to create tailored application documents.

We utilize third-party AI providers (including but not limited to Anthropic and OpenAI) to process your data and generate documents. By using our Service, you acknowledge that your data may be processed by these third-party providers.

2.1 AI Service Limitations

Your Responsibility: You are solely responsible for ensuring that all information you submit to employers is accurate, truthful, and complete. We provide tools to assist you, but the final content and its accuracy are your responsibility.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information during registration
• You must be at least 18 years old to use the Service
• You agree to notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Submit false, misleading, or fraudulent information to the Service or to employers
• Use AI-generated content without first reviewing and verifying its accuracy
• Include fabricated experience, skills, qualifications, or achievements in job applications
• Use the Service to create fraudulent or deceptive documents
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to transmit viruses, malware, or harmful code
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization

Verification Requirement: You must carefully review all AI-generated content for accuracy, completeness, and appropriateness before submitting it to any employer or third party. You are fully liable for any consequences resulting from the submission of inaccurate or false information.

5. Intellectual Property

Your Content: You retain all rights to the content you upload (resumes, job descriptions, etc.). By using the Service, you grant us a limited license to process and use your content solely to provide the Service.

Generated Documents: You own the documents generated by the Service. We do not claim ownership of your generated resumes and cover letters.

Our Platform: The Service, including its design, functionality, and underlying technology, is protected by intellectual property laws and remains our property.

6. Subscription and Payment

• Free trial users receive 3 free generations before requiring a subscription
• Subscription fees are charged monthly and are non-refundable
• We reserve the right to change pricing with 30 days' notice
• You can cancel your subscription at any time; access continues until the end of the billing period
• Payment processing is handled securely by Stripe

Consumer Rights (Norway/EEA): Consumers in Norway and the European Economic Area have statutory rights under the Norwegian Consumer Rights Act. See Section 16 below for details on your right of withdrawal and other consumer protections.

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Important: We pledge never to use your personal data, resumes, or generated documents to train our AI models or share them with third parties for training purposes.

GDPR Compliance: As a Norwegian business operating within the European Economic Area (EEA), we comply with the General Data Protection Regulation (GDPR) through Norway's implementation via the EEA Agreement. You have the rights outlined in our Privacy Policy, including access, rectification, erasure, and data portability.

8. Service Availability

While we strive for 99.9% uptime, the Service is provided "as is" without guarantees of uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, CVGenerate Studio shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from the use or inability to use the Service
• Any content generated by the AI, including but not limited to inaccurate, incomplete, inappropriate, or fabricated information
• Failure to obtain employment, job interviews, callbacks, or any career outcomes
• Any hiring decisions, employment actions, or professional consequences based on AI-generated content
• Factual errors, omissions, misrepresentations, or hallucinations in AI-generated documents
• Harm to your professional reputation resulting from the use of AI-generated content

Maximum Liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid us in subscription fees during the twelve (12) months immediately preceding the claim, or NOK 1,000 (one thousand Norwegian Kroner), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless CVGenerate Studio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of Stavanger tingrett (Stavanger District Court) in Norway.

Consumer Protection: Nothing in these Terms shall affect the mandatory statutory rights of consumers under Norwegian law or the laws of the European Economic Area. If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence.

13.1 Dispute Resolution

In the event of any dispute or controversy arising from these Terms, we encourage you to contact us first at support@cvgenerate.com to seek a resolution through good faith negotiation.

If a dispute cannot be resolved informally, you may pursue mediation or bring a claim in Stavanger tingrett. Norwegian consumers may also contact Forbrukerrådet (Norwegian Consumer Council) for assistance with consumer disputes.

16. Consumer Rights (Norway/EEA)

If you are a consumer in Norway or the European Economic Area, you have certain rights under the Norwegian Consumer Rights Act (Forbrukerkjøpsloven) and EU consumer protection directives.

16.1 Right of Withdrawal

You have the right to withdraw from your purchase within 14 days of signing up for our Service, without giving any reason.

16.2 How to Exercise Your Right of Withdrawal

To withdraw from your subscription before using the Service, send a clear statement to support@cvgenerate.com. If you withdraw within the 14-day period and have not used the Service, we will refund all payments received from you.

16.3 Consumer Dispute Resolution

If you have a complaint or dispute that we cannot resolve, you may contact Forbrukerrådet (Norwegian Consumer Council) for assistance. You may also use the European Commission's Online Dispute Resolution platform.
